www.tutto-tondo.com was created for sale to natural and legal persons in compliance with Italian legislation on distance contracts.

The sale is regulated by these General Terms and Conditions as well as by the procedures indicated in detail in the sections of this website named, respectively, PAYMENT METHODS, SHIPPING INFORMATION and PRIVACY POLICY, which must be considered an integral and substantial part of the sales contract. We therefore invite the Customer, before sending the order, to carefully read the conditions of sale as identified above and the information contained therein and to print them or save them on another durable medium accessible to him.

Any changes or new conditions of sale will be promptly notified to the Customer, will be effective from the time of publication on the site and will apply only to sales concluded after publication.

The placing of an order by the Customer constitutes acceptance of the conditions of sale in force at that time.

Article 1 General provisions

These general sales provisions are applicable to all sales of Tuttotondo products concluded at a distance via the www.tutto-tondo.com website.

The use of the remote sales service described in these General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or "Client"), understood as natural persons acting for purposes unrelated to their commercial, craft, entrepreneurial or professional activity, who are over 18 years of age (or, if minors, authorised by their legal representative).

The language available to conclude the contract through the Site is Italian.

The Client is obliged to read the General Conditions carefully, which have been made available to him/her on the Website, in order to allow them to be read, memorised and reproduced by the Client pursuant to Article 12, paragraph 3, of Legislative Decree No. 70 of 9 April 2003 ("Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to e-commerce" - hereinafter, the "Ecommerce Decree"). Contracts concluded with Beauty San Spa through the Site are governed by Italian law and, in particular, by Legislative Decree No. 206 of 6 September 2005 (hereinafter, the "Consumer Code") and the Ecommerce Decree. The seller is Beauty San Spa, with registered office in Viale Giovanni Milton, 27 - 50129 Florence - Italy, VAT number and tax code 04604720484, REA FI - 464680 - operational headquarters Via Rimini,37 -59100 Prato. Before sending an order proposal, Customers are invited to make sure they have read and understood the instructions provided during the purchase procedure and these General Conditions, since they will be binding once the contract has been concluded.

Art. 2 - Conclusion of the contract

The order sent by the Customer to Beauty San Spa must be completed in every part and must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of nullity. Beauty San Spa shall send the Customer, by e-mail, a confirmation of receipt of the order, containing a reference to the applicable conditions of sale. In accordance with the provisions of Article 53 of the Consumer Code, at the time of confirmation of the order or execution of the contract, Beauty San Spa shall send the Customer, by e-mail, a summary of the General Conditions, information on the essential characteristics of the Products purchased, a detailed indication of the price and means of payment, information on delivery costs, information on the conditions and methods for exercising the right of withdrawal, the geographical address of Beauty San Spa to which complaints may be made, information on the assistance services and commercial guarantees in place. The Customer must check the content of the communication without delay and immediately report to Beauty San Spa any errors or omissions. Without prejudice to the use of the data described in the Privacy Policy and subject to the express consent of the Customer, the order proposal form and the Customer's data relating to the order proposal shall be retained by Beauty San Spa for the period of time envisaged by the regulations in force.

 

Art. 3 - Availability and delivery

Beauty San Spa undertakes to accept orders within the limits of available stocks. In particular circumstances, Beauty San Spa may not be able to guarantee the availability of all the products offered and cannot therefore be held responsible for the temporary unavailability of one or more products.

The sending of the order by the Customer is also considered as acceptance of any partial delivery, limited to the products available within those ordered, as well as a waiver of the right to request compensation and/or indemnity. Beauty San Spa also undertakes, in accordance with the law, to promptly inform the Customer of any unavailability of the product ordered.

If, despite our vigilance, upon confirmation of payment the product should prove to be temporarily unavailable, Beauty San Spa reserves the right to offer a replacement article of equivalent quality and price, without charging additional costs to the customer. In the event that this is not possible, or in the event that the customer does not wish for a replacement, he/she may decide whether to wait for the new availability or to cancel the order, again without additional costs.

In the event of permanent unavailability, if an item of equivalent quality and price cannot be supplied, the order will be cancelled automatically and the customer will be refunded immediately.

Beauty San Spa delivers the product or products ordered by the Customer, in the manner of art. 5 and under the conditions expressly indicated in the section of this site called "Shipping Info".

 

Art. 4 - Prices and payment methods

The prices shown on www.tutto-tondo.com are in euros and include VAT.

Transport costs are excluded and, if due, are shown separately.

The prices applied are those indicated on the website at the time of the Customer's order. The prices of individual products are subject to change and, therefore, the prices indicated on the site from time to time cancel and replace those previously indicated. The price of the products purchased, together with any cost of home delivery, must be paid by the Customer at the time of the online order, by credit card or other suitable means. The fiscal documentation shall be issued by Beauty San S.p.A. at the time of delivery. The issue of the invoice must be requested in advance and the information provided by the Customer at the time of the order shall be taken as proof. No changes to the invoice shall be possible after the invoice has been issued.

For payment of the price of the products and the related shipping and delivery costs, you may use one of the methods indicated on the order form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment method you have chosen. For the safety of the customer, Beauty San S.p.A. never knows the number of the credit card, this information is in fact received only by the bank circuit that must provide authorization for payment. It is the result of the transaction that is transmitted to us. No data relating to the credit card will therefore be transcribed on the documents relating to the order, nor stored in our systems or those of the express courier.

 

Article 5 - Shipments

Deliveries are made exclusively by express courier and deliveries to P.O. boxes are not accepted.

Delivery is generally within 48/72 hours, throughout Europe, from the moment the parcel is picked up by the express courier.

N.B. These times are those indicated by the express courier and therefore we cannot guarantee them, although experience shows that they are almost always respected.

Delivery is made from Monday to Friday during normal working hours.

In the event that the courier is unable to deliver due to the absence of the recipient, after two attempts he will leave a notice of attempted delivery with details of the address to contact to arrange delivery.

Beauty San Spa shall make every effort to have the products delivered to the consumer within the time limits indicated.

The consumer is invited to contact shop@www.tutto-tondo.com in the event of delays in delivery and in any case to report any inefficiency detected. Beauty San Spa is not responsible for delays that cannot be foreseen and/or are attributable to the Courier alone. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with article 54 of the Consumer Code the Products shall be delivered within a maximum period of 30 (thirty) days from the day after the conclusion of the contract in accordance with article 2.

 

Art. 6 - Right of Withdrawal

Pursuant to art. 52 of the Consumer Code, the Customer has the right to withdraw from the contract without any penalty and without specifying the reason, within 14 days of receipt of the goods, upon written notice to be sent to Beauty San Spa Via Rimini 37 - 59100 PRATO, ITALY. In the communication the Customer must indicate the product or products for which he intends to exercise the right of withdrawal, and more precisely the written communication must contain:

The manifestation of the will to avail oneself of the benefits granted by the law.

The indication of the product purchased.

Copy of the original sales letter which must be in your possession.

In case of partial withdrawal, article code(s).

The data relating to the bank details on which to obtain the bank transfer (IBAN - Buyer's current account - BIC/SWIFT code if foreign customer).

The only costs that will be charged will be the shipping costs. The right of withdrawal only applies to goods that are undamaged at the time of return.

Beauty San Spa will provide in accordance with the law in the manner and within the time agreed with the customer to reimburse it. Alternatively, and only with the customer's consent, it will be possible to replace the product with another.

The right of withdrawal cannot be exercised if the product is not intact, i.e:

• in the absence of the original packaging;
• in the absence of product components (accessories, gifts, etc.);
• for damage to the product.

The right of withdrawal is reserved exclusively for consumers (natural persons who purchase goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal persons and natural persons acting for purposes related to their professional activity, if any.

The cost of returning the product shall be borne by the Customer.

 

Art. 7- Return of damaged goods

If an item is delivered damaged in transit, the customer does not bear the consequences, as all goods travel at our risk. In the event of damage, however, we ask you to help us to improve our service by accepting packages with reservation.

 

Article 8 - Guarantees and liability

Beauty San Spa, within the limits of availability as regulated above, guarantees that products will be delivered which are identical to those indicated and described on the website. Beauty San Spa guarantees the originality of the products.

The manufacturer's responsibility applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packaging. The images on the site are provided to the customer for the sole purpose of facilitating the recognition of products.

Art. 9 - Disputes and applicable law

Civil disputes relating to the application, execution and interpretation of the contract of sale at a distance are subject to Italian jurisdiction and will be competent Court of Florence. Contracts entered into at a distance with Beauty San Spa are governed by Italian law and, for what is not expressly provided for, the rules of law apply.
